"Buyers and your Real Estate Agent please be aware that the seller"if the California Association of REALTORS® (CAR) contract is used, is contractually obligated to have those utilities and pilot lights on. Section 9B of the CAR contract reads:
"Buyer shall complete Buyer Investigations and, as specified in paragraph 14B, remove the contingency or cancel this Agreement. Buyer shall give Seller, at no cost, complete Copies of all Buyer Investigation reports obtained by Buyer. Seller shall make the Property available for all Buyer Investigations. Seller shall have water, gas, electricity and all operable pilot lights on for Buyer's Investigations and through the date possession is made available to Buyer."
Additionally if a pool or spa or both are to be apart of the home inspection FHA regulations require the pool to have water in the pool.
As a buyer of a vacant bank owned property you are doing yourself a serious injustice if all of the utilities are not on the day of the inspection and the pool is not filled so that all of the appliances gas, water or electric appliances can be operated and inspected on your behalf. Never assume all is operational as many homes have been seriously damaged or sabotaged by the previous owner who got angry at the bank and the world for the loss of their home to foreclosure.
